Okay, lemme get this straight

SCO claims IBM put in some proprietary code in the Linux kernel.
SCO sues IBM, claiming they stole some of their code/intellectual property from the original Unix system. They ask for billions in damages as well as licensing fees.
IBM countersues SCO.
SCO refuses to identify the offending code.
The suit proceeds anyway.
SCO then plans to begin suing individual Linux users, demanding license fees.
SCO then claims 30 year old previously published code is part of the IP.

Whichever judge did not throw out the case when SCO refused to id the code needs to be removed from the bench. Whichever law firm agreed to represent SCO in this case needs to have its lawyer credentials and privilege to practice before the Bar removed.
