O’Connor’s Resignation

Fox News just read the letter of resignation delivered from Justice O’Connor to President Bush. A few observations.

  • Bill Kristol is dancing a jig for his successful prediction.
  • Jennifer observed that this will reignite the constitutional option. Yes it will, because the Democrats shouldn’t be trusted to avoid political games with the Supreme Court. If the replacement is filibustered on anything less than moral problems, then the filibuster should be abolished for court nominees.
  • I would prefer a replacement to the right of O’Connor. I know this comes as a shock, but hey, why not?
  • There is much discussion that Bush will be under pressure to appoint a female nominee. This is sad, because we are supposed to treat the sexes as equal when choosing between them on issues where sex is irrelevant to the job being done. That being said, there are plenty of qualified women to the right of O’Connor who will fill the vacancy well. There are also plenty of men who could do an equally good job.
